Procedure change of ownership
- In the event of a change of ownership, please send us a copy of the purchase contract, death certificate or deed of gift. In addition, we ask you to complete the Change of Ownership + Interim Meter Reading form and send it to us with the requested attachments; this can be done by e-mail (buchhaltung@maussner.de).
- After receipt of the documents, the change of ownership can be recorded on our part.
- Please note that we will stop the house charge debits after receipt of the documents on the requested date. If house payments have already been debited which concern the new owner of the flat, these will be refunded. For future house charge debits, we require an original SEPA direct debit mandatefrom the new owner.
With the transfer in the land register to the new owner, the former owner has left the community of owners. According to current BGH case law, the property management must always settle the accounts with the owner who is registered in the land register at the time of the owners' meeting.
Regardless of whether a change of ownership has taken place during or at the end of the business year, only one settlement is prepared for the entire business year. If the annual settlement results in a credit balance or an additional payment (so-called "settlement peak"), this is for the benefit or at the expense of the new owner.
Whether and how the seller and the buyer come to an agreement here, also with regard to the necessity of an interim statement of consumption values, is subject to their internal regulations. Provided that the seller has met all house payments according to the economic plan until the change of ownership, there are no further payment obligations towards the community of owners.
